License Agreement

Music Licensing Types

 
Here at HotMusicFactory.com, we want to make licensing music very simple for users to follow. We call this SML (Simple Music Licensing). We have 3 simple license types for you to choose from. RegularExtended and Major. Plain and simple:
 
 
Regular License
  • Under this license you, the purchaser, are granted an ongoing, non-exclusive, worldwide license to make use of the digital work (Item) you have selected.
  • You are licensed to use the Item to create one single End Product for yourself or for one client (a “single application”), and the End Product can be distributed for Free.
  • An End Product is one of the following things, both requiring an application of skill and effort.
 
(a) a customised implementation of the Item.
(b) a work that incorporates the Item as well as other things, so that it is larger in scope and different in nature than the Item.

Things you CAN do with a Regular License

  • You can create one End Product for a client, and you can transfer that single End Product to your client for any fee. This license is then transferred to your client.
  • You can make any number of copies of the single End Product, as long as the End Product is distributed for Free.
  • You can modify or manipulate the Item. You can combine the Item with other works and make a derivative work from it. The resulting works are subject to the terms of this license. You can do these things as long as the End Product you then create is one that’s permitted under sections (a) and (b) above.
 
Things you CAN'T do with a Regular License
  • You can’t Sell the End Product, except to one client. (If you or your client want to Sell the End Product, you will need the Extended License.)
  • You can’t re-distribute the Item as stock, in a tool or template, or with source files. You can’t do this with an Item either on its own or bundled with other items, and even if you modify the Item. You can’t re-distribute or make available the Item as-is or with superficial modifications. These things are not allowed even if the re-distribution is for Free.
  • Although you can modify the Item and therefore delete unwanted components before creating your single End Product, you can’t extract and use a single component of an Item on a stand-alone basis.
  • You must not permit an end user of the End Product to extract the Item and use it separately from the End Product.
  • You can’t claim copyrights to the licensed music or any derivative works that include the licensed music.
 
Example uses for the Regular License include: music bed for a multimedia presentation, music for a wedding video, music for home videos
 
 
Extended License
  • Under this license you, the purchaser, are granted an ongoing, non-exclusive, worldwide license to make use of the digital work (Item) you have selected.
  • You are licensed to use the Item to create one single End Product for yourself or for one client (a “single application”), and the End Product may be sold.
  • An End Product is one of the following things, both requiring an application of skill and effort.
 
(a) a customised implementation of the Item.
(b) a work that incorporates the Item as well as other things, so that it is larger in scope and different in nature than the Item.

 

Things you CAN do with an Extended License

  • You can create the End Product for a client, and this license is then transferred from you to your client.

  • You can Sell and make any number of copies of the single End Product.

  • You can modify or manipulate the Item. You can combine the Item with other works and make a derivative work from it. The resulting works are subject to the terms of this license. You can do these things as long as the End Product you then create is one that’s permitted under sections (a) and (b) above.

Things you CAN'T do with an Extended License
 
  • This license is a “single application” license and not a “multi-use” license, which means that you can’t use the Item to create more than one unique End Product.
  • You can’t re-distribute the Item as stock, in a tool or template, or with source files. You can’t do this with an Item either on its own or bundled with other items, and even if you modify the Item. You can’t re-distribute or make available the Item as-is or with superficial modifications.
    (For example: You can’t license a number of audio files, and re-distribute them as a package on a CD.)
     
  • Although you can modify the Item and therefore delete components before creating your single End Product, you can’t extract and use a single component of an Item on a stand-alone basis.
  • You must not permit an end user of the End Product to extract the Item and use it separately from the End Product.
  • You can’t claim copyrights to the licensed music or any derivative works that include the licensed music.
 
Example uses for the Extended License include: music for film and tv productions, video games, apps

Construction Kit Licensing

 

This document sets forth the terms and conditions of use for HOTMUSICFACTORY.COM products. By choosing to purchase, download or use HOTMUSICFACTORY.COM royalty free products you agree to adhere and follow the terms and conditions of use. These terms and conditions of use apply to all HOTMUSICFACTORY.COM products purchased and or downloaded from any HOTMUSICFACTORY.COM distributor. Be sure to review our Terms and Conditions as well.

 

1.) HOTMUSICFACTORY.COM grants you, the end user a non-exclusive royalty free license to use HOTMUSICFACTORY.COM products for your original music compositions, CDs, DVDs, Video, Mix-tapes, Games, Movies, Presentations, Websites, etc. provided that you add additional music and or vocals.

 

2.) The sounds, loops, and samples offered by HOTMUSICFACTORY.COM and its affiliates are licensed, not sold to you for use in your software and or hardware.

 

3.) You may not resale, re-license, loan, copy, assign, rent, upload, download or distribute in any way the sounds licensed to you by HOTMUSICFACTORY.COM and its affiliates to another user. In addition, these sounds cannot be offered in a competitive product.

 

4.) This non-exclusive license on HOTMUSICFACTORY.COM products is not transferable and cannot be sold, or lent to others.

 

5.) HOTMUSICFACTORY.COM retains the ownership of the products, and grants you a nonexclusive license to use them.

 

6.) The license granted is granted solely to the original user/purchaser of the product. This license is not transferable or sale-able.

 

7.) You may not sell or lend individually or isolated or complete parts of the product either alone nor included or bundled in software or hardware without the expressed written permission of HOTMUSICFACTORY.COM.

 

8.) HOTMUSICFACTORY.COM and its afiliates will not take responsibility if the sounds purchased do not meet the specific needs and or purpose of the purchaser. These sounds are licensed without warranties, therefore cannot be responsible for any indirect or direct loss arising from the use of these sounds.

 

9.) Any and all unauthorized use or duplication of any HOTMUSICFACTORY.COM product is a violation of the Terms and Conditions of use and applicable laws of the United States, and other countries. Copyright infringement will be pursued to the fullest extent of the law.

 

10.) If you are interested in a buy-out of any of our products, please contact us on our contact page to discuss the terms and conditions for obtaining exclusive ownership of products.

 

The sounds, samples, loops and MIDI files in these sample packs you purchase are licensed to you, not sold to you. All rights not expressly granted to the user are reserved. Only the original purchaser of this sample pack has a legal right to use these sounds, samples and loops within their own “original” music compositions and/or in advertisements, soundtracks, and television or film productions.

 

The content can be used for both commercial and non-commercial use. However, it may not be used in the creation of any competitive product, such as a Sample Pack, Sample CD, Sample DVD, Virtual Instrument, Expansion Pack, or any other collection of sound or loop elements in any format. These sounds, samples and loops may not be used “isolated”. They must be used within the context of a musical piece mixed with additional parts. You may not re- sell this collection or pass it on to a third party as this license is non-transferable.

 

All copying, lending, duplicating, re-selling, renting, uploading, file sharing or unauthorized trading of this content (or any part of this content) is prohibited by international copyright law. We will not hesitate to take legal action against any persons, company or individual who fail to adhere to the terms of this agreement.
